Warning – Under Texas Law (Chapter 87, Civil Practice and Remedies Code), a farm animal professional is not liable for an injury to or the death of a participant in farm animal activities resulting from the inherent risks of farm animal activities.
Inherent Risks and Assumption of Risk
Participants who participate in my 1:1 coaching, online courses, take in-person lessons, workshops or clinics acknowledge there are inherent risks associated with equine activities such as described below and hereby expressly assume all risks associated with participating in such activities.
The inherent risks include, but are not limited to the propensity of equines to behave in ways such as, running, bucking, biting, kicking, shying, stumbling, rearing, falling, charging, or stepping on, that may result in an injury, harm or death to persons on or around them; the unpredictability of equine’s reaction to such things as sounds, sudden movement, and unfamiliar objects, persons or other animals; certain hazards such as surface and subsurface conditions; collisions with other animals; the limited availability of emergency medical care; and the potential of a participant to act in a negligent manner that may contribute to injury to the participant or others, such as failing to maintain control over the animal or not acting within such participant’s ability.
The online courses are not for the extremely aggressive horse towards humans. You must be able to get your horse to back out of your space. If your horse has a history of extreme aggression, you will not be allowed to participate in the online course. If any extreme aggression is found by your horse during the course I will ask you to take that horse out of the course. My suggestion is that you work with a local trainer in your area.
Participants of the online courses acknowledge that horses, by their very nature are unpredictable and subject to animal whim. Participant assumes all risks in connection therewith, and expressly waives any claims for any injury or loss arising therefrom. The participant further acknowledges that the behavior of any animal is contingent to some extent upon the ability of the handler/rider.
Participant assumes all risks therefore and warrants a full and fair disclosure of handler/rider abilities has been made to Kim Wende owner of Passionate Horsemanship. By using this site or information given to you by Kim Wende you expressly release Kim Wende owner of Passionate Horsemanship from any and all claims for personal injury, death, or property damage, even if caused by negligence (if allowed by the laws of the State) by Passionate Horsemanship or its representatives, agents or employees.
